Judge sibakin sa kaso ng pekeng agent : Pinalaya kidnap, carnap, child abuse suspek – NBI

Pinagbibitiw ng National Bureau of Investigation ang isang judge sa Taguig City Regional Trial Court sa isang kasong hawak nito matapos niyang payagang magpiyansa ang mga pekeng anti-narcotics agent na nahaharap sa mga kasong kidnapping, child abuse at carnapping.
“In the interest of justice and fairplay, complainants herein humbly beg for the inhibition of Honorable Presiding Judge Byron G. San Pedro since we lose confidence in impartiality of the Honorable
Judge,” saad sa court document.
Sa 12-pahinang motion to inhibit na pinirmahan nina NBI Senior agents Engelbert Pulan, Jerald Galang, Jeycel Bravo, Jayson Capati, Clyde Drexler Alojado nakasaad na “It is necessary that the Honorable judge inhibit himself so as to promote the administration of Justice.”
Hiniling ng NBI kay San Pedro na bitawan na ang kaso, matapos nitong payagan noong Marso 29, 2021 ang akusadong si Edizon Baradia Jr aka JR Ordonez at Anthony Ordonez aka Tonet Ordonez na magpiyansa ng P350,000 dahil sa mahina umanong ebidenya laban sa kanila.
“The prosecution’s evidence of guilt against Baradia Jr and CICL Ordonez is weak as there is no direct evidence that will point to them to have committed the charges against them,” katwiran ng hukom.
“Proving the identity of the accused is the prosecutor’s primary responsibility,” saad pa ni San Pedro.
Gayunman, pinanindigan ng NBI sa kanilang petisyon na ang mga nagpakilalang PDEA agents nang maganap ang umano’y pagkidnap ay positibong kinilala ng kanilang mga bihag.
Sa record ng korte lumitaw na si Ordonez ay minor pa nang maganap ang insidente.
“It appears that there is danger of the partiality, bias and prejudice in favor of the accused Baradia and Ordonez for the reason that the honorable judge declared that the evidence is weak without
consideration of the testimonies of positive identification of the accused by victims-witnesses, during their court testimonies.”
Sinabi pa ng NBI na ang petition for bail ay ipinagkaloob nang walang abiso sa mga biktima.
Dahil napalaya pansamantala ang mga akusado ay nanganganib ngayon ang mga biktima.
“The liberty of the accused will pose danger to victims-witnesses since they live in the same vicinity and the accused were proven recidivist,” dagdag pa nito.
“The warrants of arrest of Ordonez were served when he was arrested for possession of shabu worth P1.2 million by the Makati Police while, Baradia warrants was served when he was arrested with another accused for illegal possession of Firearms and Ammunitions.”
